We provide mortgage lending and loan origination services in Montana and California. You own your personal and financial data; we use it only to process your loan. Payments and fees are governed by your loan agreement and applicable federal and state lending laws. We work hard to find you the best loan options but cannot guarantee specific rates, approvals, or outcomes. Any disputes will be handled per Montana or California law. Your financial information is kept secure and confidential. Either party may discontinue the relationship at any time prior to a signed loan commitment.
1. Agreement to Terms
Acceptance of Terms
By accessing or using any services provided by Doug Ross Mortgage (“Company,” “we,” “us,” or “our”), including our website (www.rossloan.com), assessments, consultation services, implementation services, and ongoing support (“Services”), you (“Client,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy.
Capacity and Authority
You represent and warrant that:
- You have the legal capacity and authority to enter into these Terms
- If acting on behalf of a business entity, you have the authority to bind that entity
- You are at least 18 years of age
- Your use of our Services complies with all applicable laws and regulations
Modifications to Terms
We reserve the right to modify these Terms at any time, with material changes becoming effective thirty (30) days after notice via email or prominent website posting. Continued use of our Services after such notice constitutes acceptance of modified Terms. The most current version of these Terms can always be found at www.rossloan.com.

Core Service Offerings
Doug Ross Mortgage provides the following services to residential and commercial clients seeking home financing solutions in Montana and California:
- Mortgage Loan Origination: Professional evaluation and processing of home purchase and refinance loan applications tailored to each client’s financial situation
- Pre-Approval Assistance: Comprehensive pre-approval services to help buyers understand their purchasing power and move confidently in today’s competitive market
- Home Purchase Loans: Guidance and loan origination for first-time buyers, repeat buyers, and those relocating to Montana or California
- Refinancing Services: Evaluation and processing of refinance options to help existing homeowners reduce rates, lower payments, or access equity
- After-Hours Support: Client consultations and support available outside standard business hours to accommodate busy schedules
- Multi-Lender Access: Through our partnership with Pacific Wholesale Mortgage (NMLS
#979693), we provide access to 50+ lenders and a wide range of competitive loan programs
Additional Services
Doug Ross Mortgage also provides personalized consultations, mortgage education, and ongoing communication support to guide clients through every stage of the home financing process.
Service Limitations
Our services are professional in nature. We do not provide:
- Legal or financial planning advice
- Guaranteed loan approval or specific interest rate guarantees
- Real estate agent or property valuation services
- Services outside the states of Montana and California without proper licensure
3. User Obligations and Acceptable Use
Client Responsibilities
You agree to:
- Provide accurate and complete information for service delivery
- Maintain confidentiality of access credentials
- Cooperate reasonably with our service delivery processes
- Designate appropriate personnel for training and collaboration
- Maintain adequate IT infrastructure to support implementation
- Comply with all applicable laws and regulations
- Ensure you and all users of your account comply with applicable laws at all times, including laws governing advertising, marketing claims, email marketing (CAN-SPAM Act), telemarketing (TCPA), and testimonials (FTC Endorsement Guides)
Prohibited Uses
You may not:
- Use our Services for any unlawful purpose
- Reverse engineer or derive source code from our systems
- Resell, redistribute, or sublicense our Services without express written consent
- Use our Services to develop competing products
- Interfere with or disrupt our systems or networks
- Violate intellectual property rights of any third party
- Import sensitive information (SSNs, credit card data, passwords, health records) into any system hosted or provided by Doug Ross Mortgage unless expressly authorized
- Use any messaging software or services in violation of applicable laws, including the Telephone Consumer Protection Act
4. Intellectual Property Rights
Company Proprietary Rights
All right, title, and interest remain exclusively owned by Doug Ross Mortage:

- Proprietary loan programs and lender relationships
- Client communication workflows and processes
- Website content, branding, and marketing materials
Software & Technology
- Proprietary software and applications
- AI models, prompts, and algorithms
- System configurations and protocols
- Dashboard interfaces and reporting tools
- Training materials, documentation, educational curricula, and templates
Client Data and Information
You retain all rights to your business data, customer information, and proprietary business processes. We claim no ownership interest in your data beyond the limited rights necessary to provide Services.
Work Product and Deliverables
Custom configurations and deliverables created specifically for your business become your property upon full payment, subject to our retention of underlying intellectual property rights.
User-Generated Content
If you post reviews, testimonials, comments, photos, videos, or other content, you grant Doug Ross Mortgage a nonexclusive, royalty-free, perpetual, irrevocable, worldwide, and fully sublicensable right to use, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute, and display such content in any media. You represent and warrant that you own or control all rights to content you submit, and that such content is accurate and does not violate these Terms or any law.
5. Payment Terms and Billing
Service Fees and Payment
Service fees are as quoted in individual Service Agreements. Payment terms are net thirty (30) days unless otherwise specified. All fees are exclusive of applicable taxes. All prices are in U.S. Dollars.

Subscription Terms and Automatic Payments
If you subscribe to any recurring Doug Ross Mortgage service, you authorize automatic recurring charges at the agreed-upon interval. Failure to use available services does not relieve you of payment obligations. You acknowledge that we hold transaction data including the last four digits and expiration date of the card used for payment.
If you wish to cancel a subscription, you must submit a cancellation request to ross.team@outlook.com or through your account dashboard. For monthly subscriptions, we require at least ten (10) days’ notice before the first day of your next billing cycle. Cancellation requests submitted with less than ten (10) days’ notice may result in charges for the following billing cycle.
Refund Policy
- Fees associated with loan origination are governed by your loan agreement and applicable federal lending laws. Application fees, if any, are disclosed upfront per RESPA requirements. Rate lock fees and third-party costs (appraisal, title, etc.) are subject to the terms outlined in your Loan Estimate.
Late Payments and Disputes
Late payments are subject to a service charge of 1.5% per month (18% annually) or the maximum rate permitted by law. Billing disputes must be raised within sixty (60) days of invoice date. In the event of collection proceedings, you will be liable for all collection costs, including legal fees and expenses.
6. Data Protection and Privacy

Consistent with our core value of data sovereignty, we commit to:
- Storing your financial and personal data securely in compliance with federal mortgage lending regulations
- Using cloud services only when necessary and with your explicit consent
- Ensuring all data processing complies with applicable privacy laws
- Never selling or monetizing your business data
Note: While we prioritize local hosting solutions, some services may require cloud or hybrid architectures to deliver optimal functionality.
Security Measures
We maintain industry-standard security measures including:
- Encryption of data in transit and at rest
- Regular security audits and assessments
- Employee training on data protection
- Incident response procedures
- Business continuity planning
Data Retention and Deletion
We retain Client data only as long as necessary to provide Services and meet legal obligations. Upon termination, we will return or delete Client data as requested, subject to legal retention requirements.
Privacy Policy
Your submission of personal information through our website is governed by our Privacy Policy, available at www.rossloan.com. Our Privacy Policy is incorporated into these Terms by reference.
7. Results Disclaimer
Every business is different, employing different strategic approaches and organizational structures. Therefore, individual results will vary.
YOUR BUSINESS’S INDIVIDUAL RESULTS WILL VARY DEPENDING UPON A VARIETY OF FACTORS UNIQUE TO YOUR BUSINESS, INCLUDING BUT NOT LIMITED TO YOUR CONTENT, BUSINESS MODEL, AND PRODUCT AND SERVICE OFFERINGS.
Doug Ross Mortgage does not promise, guarantee, or warrant your business’s success, income, or sales. We do not make earnings claims, effort claims, return on investment claims, or claims that our tools or services will make your business any specific amount of money. It is possible that you will not earn your investment back.
Testimonials represent the unique experience of the participants submitting them and do not necessarily reflect the experience you may have. We reserve the right to edit testimonials for grammar, length, and clarity prior to publication.
We do not offer tax, accounting, financial, or legal advice. You should consult your own accountant, attorney, or financial advisor for advice on these topics.
8. Warranties and Disclaimers
Limited Warranty
We warrant that our Services will be performed in a professional and workmanlike manner consistent with industry standards. Our sole obligation for breach is to re-perform deficient Services or refund fees for Services that cannot be corrected.
Technology Disclaimers
- Third-Party Platforms: We use GoHighLevel and Pacific Wholesale Mortgage systems; we are not responsible for third-party platform outages or errors
- Third-Party Integration: We disclaim responsibility for third-party system performance, including but not limited to CRM platforms, social media platforms, messaging services, and internet browser notifications.
- Results: Cannot guarantee specific business outcomes or improvements.
EXCEPT AS EXPRESSLY SET FORTH HEREIN, WE PROVIDE SERVICES “AS IS” AND “AS AVAILABLE” AND DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE. WE DO NOT REPRESENT OR WARRANT THAT: (A) THE USE OF OUR SERVICES WILL BE SECURE, TIMELY, UNINTERRUPTED OR ERROR-FREE; (B) OUR SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS; (C) ANY STORED DATA WILL BE ACCURATE OR RELIABLE; OR (D) ERRORS OR DEFECTS WILL BE CORRECTED.
9. Limitation of Liability
Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.
Exclusion of Consequential Damages
IN NO EVENT SHALL DOUG ROSS MORTGAGE OR ANY OF ITS OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, INDEPENDENT CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, GOODWILL, USE, OR COST OF PROCUREMENT OF SUBSTITUTE SERVICES, REGARDLESS OF THE MANNER IN WHICH DAMAGES ARE CAUSED AND ON ANY THEORY OF LIABILITY.
Exceptions: These limitations do not apply to gross negligence, willful misconduct, intellectual property violations, confidentiality breaches, or liability that cannot be limited under applicable law.
10. Dispute Resolution
Informal Resolution
Before initiating formal proceedings, parties agree to attempt good-faith resolution through direct negotiation for one hundred twenty (120) days. Contact us at ross.team@outlook.com to initiate this process.
Binding Arbitration
PLEASE READ THIS ARBITRATION PROVISION CAREFULLY. EXCEPT WHERE PROHIBITED BY LAW, YOU AGREE THAT ANY CLAIM MUST BE RESOLVED THROUGH FINAL AND BINDING CONFIDENTIAL ARBITRATION. YOU ACKNOWLEDGE AND AGREE THAT YOU ARE WAIVING THE RIGHT TO A TRIAL BY JURY.
Any dispute not resolved through negotiation shall be settled by binding arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules. The AAA’s Rules are available at www.adr.org or by calling 1-800-778-7879.
Arbitration Procedures
- Location: Billings, Montana
- Language: English
- Applicable Law: State of Montana, without regard to conflict of law principles
- Arbitrator: Single neutral arbitrator selected by agreement of the parties or per AAA rules
- Discovery: Limited to directly relevant information
- Confidentiality: All proceedings confidential
Payment of all filing, administration, and arbitrator fees will be governed by the AAA’s Rules. In all other respects, the parties shall each pay their own additional fees, costs, and expenses.
Class Action Waiver
YOU AGREE THAT ANY ARBITRATION SHALL BE CONDUCTED IN YOUR INDIVIDUAL CAPACITY ONLY AND NOT AS A CLASS ACTION OR REPRESENTATIVE PROCEEDING. YOU FURTHER AGREE THAT THE ARBITRATOR MAY NOT CONSOLIDATE PROCEEDINGS OR PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.
If the class action waiver is deemed unenforceable, then this entire arbitration provision shall be rendered null and void.
Exceptions to Arbitration
Either party may seek court injunctive relief for intellectual property violations, confidentiality breaches, or violations requiring immediate relief. Such claims shall be brought exclusively in the state or federal courts located in Billings, Montana, and you irrevocably consent to the exclusive jurisdiction and venue of such courts.
All claims must be brought within one (1) year after the claim arises (including the 120-day informal resolution period).
11. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Doug Ross Mortgage, its directors, officers, employees, shareholders, independent contractors, subcontractors, suppliers, affiliates, and agents from and against any and all claims, actions, losses, liabilities, damages, expenses, demands, and costs (including attorneys’ fees) arising out of or related to:
- Your use, misuse, or attempted use of our Services, website, software, or products
- Information you submit or transmit through our Services
- Your breach of these Terms or any representations and warranties herein
- Your violation of any law or the rights of a third party
- Your use or misuse of any messaging software or hardware, whether provided by Doug Ross Mortgage or a third party
12. Communication Consent and SMS/MMS Terms
SMS/MMS Messaging Program
Doug Ross Mortgage offers an SMS/MMS messaging program to provide service notifications, appointment reminders, assessment results, and other business communications related to your use of our Services.
Consent
By submitting forms on our website, engaging with our Services, or providing your contact information, you consent to receive communications from Doug Ross Mortgage including email, SMS/MMS messages, phone calls, and AI-assisted voice communications. You agree to be contacted on a recurring basis for as long as you are a part of our communication programs. Message frequency varies.
Opt-Out
You can cancel the SMS service at any time. Simply text “STOP” to the phone number from which you received the message. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
Mobile Information Sharing
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, excluding aggregators and providers of the Text Message services.

13. Termination
This Agreement takes effect when you access our website, submit information, purchase services, or otherwise engage with Doug Ross Mortgage. If, in our sole discretion, you fail to comply with any term of this Agreement or violate any law, we may terminate this Agreement or suspend your access at any time without notice.
Upon termination, you remain responsible for any outstanding payments to Doug Ross Mortgage. Sections 4, 7, 8, 9, 10, 11, and 12 shall survive termination of this Agreement.
14. DMCA and Copyright
If you believe that materials available on our website infringe any copyright you own, you or your agent may send Doug Ross Mortgage a notice requesting removal. Notices and counter-notices should be sent to ross.team@outlook.com.
15. Third-Party Links
Our website may contain links to other websites. Doug Ross Mortgage is not responsible for the content on, or privacy practices of, any third-party sites. Those sites have their own privacy policies and terms of use.
16. General Provisions
Governing Law and Venue
This Agreement shall be governed exclusively by the laws of the State of Montana without regard to its conflict of law principles. Any claim excluded from arbitration shall be brought exclusively in the state or federal courts located in Billings, Montana.
Force Majeure
Doug Ross Mortgage will not be responsible for any delay, damage, or failure caused by acts of nature or other causes beyond our reasonable control.
Assignment
Doug Ross Mortgage may assign its rights under this Agreement at any time without notice. Your rights under this Agreement cannot be assigned without our express written consent.
Electronic Signature
You agree that electronic communications between you and Doug Ross Mortgage are equivalent to written communications and shall have the same force and effect as if signed in writing.
No Waiver
No failure or delay on the part of Doug Ross Mortgage in exercising any right shall operate as a waiver. A waiver shall only be effective if in writing and signed by Doug Ross Mortgage.
Severability
If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision may be modified to the extent necessary to make it enforceable.
Entire Agreement
These Terms, together with our Privacy Policy and any Service Agreements, constitute the entire agreement between you and Doug Ross Mortgage and supersede all prior agreements, representations, and proposals, whether oral or written.
